An online ugg-boot trader has been fined $430,000 for falsely claiming its goods were made in Australia, instead of China, and using the Australian Made logo to illustrate its claims.
Marksun Australia by the Federal Court for engaging in false and misleading conduct – including $100,000 for unauthorised use of the Australian Made logo – after action was taken by the Australian Competition and Consumer Commission.
Marksun Australia’s goods were in fact made in China.
“Justice Gilmour’s decision is a win for shoppers and the more than 1700 businesses registered to use the logo,” AMAG Chief Executive Ian Harrison sais.
“The Australian Made logo is in fact a certification trademark which means businesses must follow strict rules when using it.
“More importantly, shoppers have the right to know where the products they buy come from.
“Marksun showed complete disregard for both these points and as a result must face the consequences of the law.”
